The following are excluded from the Game: the Organiser's directors, employees and work-study students, any person involved in organising the Game, and the members of their household (persons living under the same roof).

3.3 – Cancelled or returned orders

Any order that is cancelled, returned or refunded, in whole or in part, results in the cancellation of the corresponding entries, which are recalculated on the amount finally kept by the customer.

Entries are linked to the contact details provided when placing the order. Participants guarantee that these details are accurate; any false or incomplete details will render the entry void.

Article 4 – THE PRIZE

A single prize is offered. It includes:

  • two direct return flights Paris–Tokyo, economy class, with Japan Airlines or Air France, departing from Paris-Charles-de-Gaulle, one for the winner and one for the companion of their choice. If the companion is a minor, they travel under the sole responsibility of the winner, who must be their legal guardian or hold the authorisation to leave the country signed by the legal guardian;
  • six consecutive nights for two people in a carefully selected hotel in Tokyo, in a double room, meals not included, on the travel dates booked by the Organiser;
  • two Ubigi Japan eSIMs of 50 GB each, valid for the duration of the stay, one for the winner and one for their companion;
  • a selection of Human With Attitude pieces with a total value of €500 including VAT, chosen by the Organiser for the winner and their companion, according to their sizes and available stock. The pieces cannot be returned or exchanged.

Indicative total value of the prize: €5,000 including VAT.

Tickets are booked by the Organiser. The winner may suggest several travel dates of their choice, from which the Organiser will set the final dates, depending on flight and accommodation availability.

The trip must take place between the date the winner is announced and 28 February 2028, excluding peak tourist and pricing periods in Japan.

The requested dates must be communicated at least 8 weeks before departure. Once issued, tickets can be neither changed nor refunded.

The following are borne by the winner and their companion: travel to the departure airport, meals, local transfers, any baggage beyond the allowance included in the flight tickets, insurance, travel documents (valid passport and entry formalities for Japan), visa and any personal expenses.

The prize is personal. It cannot be transferred, exchanged or refunded in cash. In the event of force majeure or unavailability, the Organiser may replace it with a prize of equivalent or greater value.

Article 5 – PRIZE DRAW

The draw is carried out by a French judicial officer (commissaire de justice) between 20 and 22 January 2027, i.e. at least forty (40) days after the end of the Game, so that the return period applicable to orders placed during the Game has expired.

It covers all entries valid on that date, each entry having an equal chance of being drawn. It follows the method below:

  • Entry file: the Organiser draws up, from the orders placed on the website, a file listing each participating order (order number, name, email address and number of entries calculated in accordance with Article 3), after deduction of cancelled, returned or refunded orders. This file is handed to the judicial officer, who records its digital fingerprint (SHA-256) in order to identify with certainty the file used.
  • Ticket numbering: each entry corresponds to one ticket. Tickets are numbered from 1 to N (N being the total number of valid entries), in consecutive ranges assigned to each order in the order of the file. An order with five (5) entries therefore holds five (5) consecutive numbers.
  • Draw: a number between 1 and N is drawn using a cryptographic random number generator, giving each ticket an identical probability of being drawn. The order holding the drawn ticket is selected.
  • Winner and reserves: the first draw designates the winner; the following five (5) draws designate the reserves, in order. If a drawn ticket belongs to an order or a participant already selected, that draw is discarded and a new draw is made.
  • Official report: the judicial officer records in an official report the file's fingerprint, the number of orders and tickets in play, and the time-stamped log of each draw (number drawn, corresponding order and result).

Article 6 – SELECTION AND NOTIFICATION OF THE WINNER

The winner is notified by email and/or telephone, using the contact details provided with their order, within three (3) working days of the draw. They have seven (7) calendar days from this notification to confirm acceptance of the prize and provide proof of identity and address.

If no reply is received within this period, or if the conditions of these rules are not met, the prize is awarded to the first reserve, then to the following reserves in the order of the draw. Each reserve has the same period of seven (7) calendar days to confirm acceptance of the prize.

With their consent, the winner authorises the Organiser to publish their first name, the initial of their surname and their city on the brand's website and social networks, with no consideration other than the prize. Any participation in photo or video content related to the trip will be subject to a separate and optional agreement.

Article 7 – PERSONAL DATA

The Organiser, as data controller, collects participants' data (surname, first name, contact details, order history, early access registration) for the management of the Game, the draw and the delivery of the prize. This data is shared with the judicial officer for the purposes of the draw and kept for as long as necessary for the Game and the handling of any claims.

In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, each participant has the right to access, rectify, erase, restrict and object to the processing of their data, which they may exercise by email at concours@humanwithattitude.com. They may also lodge a complaint with the CNIL.

Article 8 – LIABILITY AND CHANGES

The Organiser cannot be held liable for any malfunction of the website, the internet network or payment methods preventing an order or an entry, nor for any delay, cancellation or change to the flight attributable to the airline.

The Organiser reserves the right to shorten, extend, modify or cancel the Game in the event of force majeure or circumstances beyond its control. Any change will be made by updating these rules, published on the website.

Any fraud or attempted fraud, in particular through multiple orders that are subsequently cancelled or returned, will result in the exclusion of the participant concerned.

This contest is in no way sponsored, administered by or associated with Facebook, Instagram or Meta. Participants release Meta from any liability relating to this operation.

Article 9 – CLAIMS

Any claim relating to the Game must be sent in writing to the Organiser, at the address given in Article 1 or by email to concours@humanwithattitude.com, stating the participant's contact details, order number and the reason for the claim.

The Organiser undertakes to review any claim received within a reasonable time.

Article 10 – GOVERNING LAW

The Game and these rules are governed by French law. Failing an amicable settlement, any dispute shall fall within the jurisdiction of the competent courts under ordinary law.

Article 11 – ACCESS TO THE RULES

These rules are available free of charge at https://humanwithattitude.com/pages/reglement-concours-tokyo throughout the Game and may be sent free of charge to anyone who requests them from the Organiser.

Participation in the Game implies full and complete acceptance of these rules.
